The Trade Remedies Authority (Ministry of Industry and Trade) announced that the U.S. Department of Commerce (DOC) has issued the final conclusion of the scope review and anti-evasion investigation concerning wooden cabinets imported from Vietnam.
Regarding the scope review, DOC maintains the preliminary conclusions adjusted in September 2023. Accordingly, three cases of wooden cabinets imported from Vietnam with components manufactured in China fall within the scope of the existing duty orders on China, including:
- Products with doors, drawer fronts, and wooden frames manufactured in China, then assembled in Vietnam and combined with cabinet boxes and drawer boxes manufactured in Vietnam.
- Products with doors, drawer fronts, and wooden frames as semi-finished products manufactured in China, then further processed in Vietnam and combined with cabinet boxes and drawer boxes manufactured in Vietnam.
- Products with semi-finished components of doors, drawer fronts, and wooden frames (including strips, posts, and panels) manufactured in China, then further processed in Vietnam and combined with cabinet boxes and drawer boxes manufactured in Vietnam.
The DOC will notify U.S. Customs and Border Protection (CBP) to apply the Certificate Regime for wooden cabinets imported from Vietnam. This regime allows Vietnamese exporters of wooden cabinets not falling under the three aforementioned cases to be exempt from anti-dumping/countervailing duties when exporting to the U.S.
Vietnamese exporters need to complete the self-certification form for exporters and provide a copy along with supporting documents (invoices, orders, production records, etc.) to the U.S. importer. The importer must complete the self-certification form for importers before shipping the goods. Additionally, enterprises must retain the records and documents supporting their certification for five years from the date of export for verification by U.S. authorities if necessary.
Regarding the anti-evasion investigation, DOC has canceled the entire investigation on anti-dumping/countervailing duty evasion for wooden cabinets imported from Vietnam.
To best protect the rights and interests of Vietnamese exporters, the Trade Remedies Authority recommends associations and relevant exporters understand and fully comply with the U.S. Certificate Regime requirements; continue to monitor early warning information to develop appropriate business and export plans; and inform the Trade Remedies Authority of any arising issues for timely support.
The scope review and anti-evasion investigations were initiated by DOC in May and June 2022, respectively. Since April 2020, the U.S. has imposed anti-dumping (AD) and countervailing duties (CVD) on wooden cabinets originating from China, with AD rates ranging from 4.37% to 262.18% and CVD rates from 13.33% to 293.45%.
